Notice of Application
A Notice of Application is the document used to formally commence certain estate litigation proceedings in the Ontario Superior Court of Justice. This document outlines the legal basis for the claim, the relief being requested from the court, and the parties involved in the dispute. In estate matters, Notices of Application are commonly used in will challenges, passing of accounts proceedings, guardianship applications, and dependant relief claims. Properly drafting and serving a Notice of Application is an important first step in advancing or responding to estate litigation in Ontario.
